1. Who These Terms Apply To
The Service is intended for business use. You confirm that you have authority to bind the organisation you represent. If you do not agree, do not use the Service.
2. Your Account
- You must provide accurate information and keep it up to date.
- You are responsible for activity on your account and for keeping credentials secure.
- If you use team accounts, administrators may add/remove members and control permissions.
3. The Service
Konvrtd helps digital marketers research domains, identify contacts, and generate outreach drafts (including AI-generated email sequences). The Service may change over time.
4. Credits and Usage
Certain features consume credits. The credit cost may vary by feature and is shown in-product.
- Free accounts may have limited or zero credits.
- Paid plans may include periodic credit replenishment.
- Credits are consumed when actions are performed. Failed operations caused by our systems may be refunded automatically.
- Except for refunds due to failed operations, credits are non-refundable.
5. Payments
If you purchase a subscription, charges and billing are handled by our payment providers (for example, Stripe or Lemon Squeezy). Subscriptions renew automatically unless cancelled. You are responsible for taxes where applicable.
6. Gmail Integration and Third-Party Services
If you connect a third-party integration (such as Gmail), you authorise us to access the integration according to the permissions you grant during the connection flow. You can revoke access at any time via the provider.
You are responsible for complying with the provider terms and for all messages sent from your account.
7. Acceptable Use and Compliance
You must use the Service lawfully and responsibly. You must not:
- Send spam or unlawful/unsolicited marketing communications.
- Use the Service to violate data protection, privacy, or e-marketing laws (including UK GDPR and PECR).
- Interfere with the Service, circumvent usage limits/credits, or attempt unauthorised access.
- Scrape, resell, or redistribute the Service or any datasets beyond normal, intended use.
8. AI-Generated Content
The Service may generate content using automated systems and AI. You are responsible for reviewing and approving any content before using it.
- Ownership: Konvrtd Ltd retains all rights and ownership in AI-generated outputs produced by the Service.
- Your licence: we grant you a limited, revocable, non-exclusive licence to use generated outputs within your organisation for your internal business purposes.
- No guarantees: outputs may be inaccurate and are provided "as is".
9. Intellectual Property
The Service, software, and branding are owned by Konvrtd or its licensors. You may not copy, modify, or create derivative works from the Service except as permitted by law.
10. Suspension and Termination
You may cancel your account at any time. We may suspend or terminate access if you breach these Terms or if necessary to protect the Service, other users, or third parties.
Account deletion: upon cancellation, your account data is removed immediately. We may retain limited records where required by law (for example, payment records).
11. Disclaimers
The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that it will generate specific results.
12. Limitation of Liability
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.
Subject to the above, Konvrtd Ltd will not be liable for any indirect or consequential losses, or loss of profit, revenue, goodwill, or data. Our total liability for all claims relating to the Service is limited to the amount you paid to us for the Service in the 12 months before the event giving rise to the claim.
13. Changes
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you.
14. Governing Law
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
